Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the website at softwareisnottheagency.com, the private reader portal, and the related digital content and services (together, the “Portal”). The Portal and the book Software Is Not the Agency are operated and published by MQL Solutions LLC, doing business as Seamless Growth AI (“Seamless Growth AI,” “we,” “us,” or “our”). By accessing, purchasing, or using the Portal, you agree to these Terms. If you do not agree, do not use the Portal.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase or use the Portal. By using the Portal you represent that you meet these requirements.

2. What you are purchasing

The Portal is a private, digital reader experience built around the book Software Is Not the Agency. For a one-time fee of $47, you receive lifetime personal access to the digital book, the audiobook, and the implementation resources included in the Portal at the time of purchase. The Portal is delivered digitally and there is no physical product. This is a personal license to access the content, not a sale or transfer of the content itself.

3. License and acceptable use

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Portal for your own personal, non-commercial use. You agree that you will not, and will not permit anyone else to:

• Copy, download (except as the Portal expressly allows), reproduce, record, screen-capture, distribute, publicly display, resell, or sublicense any part of the content;
• Share your login, access code, or account with anyone, or allow others to access the Portal through your access;
• Create derivative works from, or use the content to build a competing product; or
• Circumvent, disable, or interfere with any access control or security feature of the Portal.

We may suspend or revoke access that we reasonably believe violates these Terms, without a refund.

4. Educational purpose and no professional advice

The Portal is provided for general educational and informational purposes only. Nothing in it is legal, financial, tax, investment, or accounting advice. We do not guarantee any particular income, revenue, client, or business result. Your results depend on many factors outside our control. Please review our Earnings Disclaimer.

5. Payment and no refunds

Payment is processed by our third-party payment processor. Because the Portal provides immediate access to protected digital content, all sales are final and no refunds are offered, except where a refund is required by law. See our No-Refund Policy and Digital Access Notice.

6. Intellectual property

The Portal and its content, including the book, audiobook, text, graphics, logos, worksheets, and software, are owned by or licensed to MQL Solutions LLC and are protected by copyright and other laws. All rights not expressly granted to you are reserved.

7. Third-party services

The Portal relies on third-party services for payment, email delivery, hosting, and media streaming, and may link to third-party sites such as seamlessgrowth.ai. We are not responsible for the content, policies, or practices of any third party, and your use of a third-party service is governed by that party’s terms.

8. Disclaimers

The Portal is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Portal will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the fullest extent permitted by law, MQL Solutions LLC and its owners, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising from your use of the Portal. Our total liability for any claim relating to the Portal will not exceed the amount you paid for access.

10. Indemnification

You agree to indemnify and hold harmless MQL Solutions LLC from any claims, losses, or expenses arising out of your use of the Portal or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Illinois, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date will reflect the most recent version. Your continued use of the Portal means you accept the updated Terms.
